Attorney General Todd Rokita Takes Victory Lap as SCOTUS Rules Trump Eligible for 2024 Ballot

Written from press release

WASHINGTON D.C. – March 4, 2024

Indiana Attorney General Todd Rokita celebrated a significant triumph as the U.S. Supreme Court unanimously sided with former President Donald Trump, affirming his eligibility to appear on the Colorado ballot for the 2024 presidential election. Rokita, who co-led a coalition of 27 states in support of Trump, expressed satisfaction with the 9-0 decision, calling it a victory for liberty and electoral integrity, according to a press release from Rokita’s office.

“I predicted this unanimous decision since the beginning,” said Attorney General Rokita. “This was a clear attempt to disenfranchise and dilute the voices of millions of voters who benefited from former President Donald Trump’s time as Commander in Chief.”

The U.S. Supreme Court’s opinion aligns with the central argument presented in two amicus briefs, one with 25 states and another with 27 states, both led by Indiana and West Virginia. The crux of the argument rests on the interpretation that, in this unique instance, Section 3 of the Fourteenth Amendment grants Congress, not individual states, the authority to determine the eligibility of candidates for federal office.

“With a 9-0 decision, I hope we can all now finally agree that Trump has a right to appear on the ballot,” Rokita emphasized. “This is a huge win for liberty and preserves confidence in the integrity of our elections.”

The Supreme Court’s ruling not only allows Trump’s candidacy on the Colorado ballot but sets a precedent that prevents individual states from utilizing Section 3 to bar candidates from the ballot. This resolution is applicable nationwide, providing clarity on the constitutional authority over federal office candidacy eligibility.
